1. Who we are

Ignite Mortgages Pty Limited ABN 73 694 352 371 ("Ignite Mortgages", "we", "us", "our") is a mortgage broking business based in Maroubra, NSW. We are an Authorised Credit Representative (Credit Representative Number 576685) of Loan Market Pty Ltd ABN 89 105 230 019, Australian Credit License 390222 ("Loan Market").

We respect your privacy. This policy explains how we collect, use, hold and disclose your personal information, including credit information, and how you can access it, correct it or make a complaint.

We are bound by the Privacy Act 1988 (Cth), including the Australian Privacy Principles and the credit reporting rules in Part IIIA and the Privacy (Credit Reporting) Code.

This policy applies to clients, prospective clients and anyone who contacts us or uses our website. Loan Market also handles your information as our licensee, under its own privacy policy, available at loanmarket.com.au/privacy-policy.

2. What information we collect

What we collect depends on how far you go with us.

If you make an enquiry through our website, we only collect your name, email, mobile number, what you need help with and any message you choose to include, plus the technical data described in section 9.

If you become a client, we collect more information during our meetings and through the loan application process, because lenders and the law require it. Depending on your situation, this may include:

  • Identity and contact details: name, date of birth, address, email, phone number and identity documents such as a driver’s license or passport.
  • Financial information: income, employment, expenses, assets, liabilities, bank statements, tax returns, superannuation and insurance details.
  • Credit information: credit reports and scores, repayment history, defaults and existing credit accounts.
  • Household information: marital status, dependents and residential history.
  • Property and loan details: the property you are buying or refinancing, your current loans and your goals.
  • Enquiry information: the details you give us in our enquiry form.

We will only ask for your tax file number where the law requires it, and we never use a government identifier as our own reference number.

Sensitive information

We only collect sensitive information, such as health information, with your consent and where it is relevant, for example if you are applying for hardship assistance or if your health affects your income. We may also collect it where the law requires.

3. How we collect it

We collect most information directly from you, in person, by phone, by video call, by email, through our website or through our secure online fact-find and document upload tools.

With your consent, we may also collect information from:

  • lenders, mortgage insurers and Loan Market;
  • credit reporting bodies, when we obtain your credit report as your agent;
  • your co-applicants or guarantors;
  • your accountant, solicitor, conveyancer, financial adviser, employer or real estate agent;
  • referral partners who introduce you to us; and
  • identity verification services and publicly available sources.

With your permission, we may record or transcribe meetings and calls so we can keep accurate notes of your needs. You can ask us not to.

If you don't give us the information we ask for, we may not be able to help you find a suitable loan, or a lender may decline your application. You can make a general enquiry without identifying yourself.

4. Why we collect and use it

We use your information to:

  • understand your needs and objectives, and assess whether a loan is suitable for you, as required by our responsible lending and best interests obligations;
  • compare loan options and recommend products;
  • prepare and submit loan applications, and manage them through to settlement;
  • verify your identity, as required by anti-money laundering laws;
  • provide ongoing service, such as loan reviews and rate checks;
  • refer you to other service providers, such as insurance, conveyancing or financial advice, if you ask us to;
  • send you information about products and services, if you have not opted out (see section 8);
  • handle complaints and disputes; and
  • meet our legal, regulatory, record-keeping and audit obligations, including Loan Market's obligations as our licensee.

5. Who we share it with

We only share your information for the purposes above, or where you consent or the law requires. Depending on your situation, we may share it with:

  • Loan Market and the Loan Market Group, which supply our software, compliance and support services and must keep records of the credit assistance we provide;
  • lenders and credit providers you apply to, or whose products we are comparing for you;
  • mortgage insurers, valuers and title insurers involved in your loan;
  • credit reporting bodies and identity verification services;
  • your representatives, such as your accountant, solicitor, conveyancer, financial adviser or anyone you authorise;
  • co-applicants and guarantors on the same application;
  • service providers that help us run our business, such as IT, cloud storage, document management, CRM, email and website providers;
  • referral partners who introduced you to us, limited to the status of your loan, and only with your consent;
  • other service providers you ask to be referred to, such as insurers or financial advisers;
  • auditors, our professional advisers and insurers; and
  • regulators, government agencies, courts and AFCA, where required or authorised by law.

If we receive a referral fee or commission, we will tell you in our Credit Guide and Credit Proposal. We do not sell your personal information.

6. Credit reporting

With your consent, we may obtain your credit report from a credit reporting body as your agent (an "access seeker"), so we can understand your credit position and recommend suitable lenders. We may share this information with the lenders you apply to. Lenders will also obtain their own credit reports.

We may deal with these credit reporting bodies:

Each credit reporting body has a policy explaining how it manages credit information, available on its website. You can get a free copy of your credit report from each of them every three months, and you can ask them not to use your credit information for pre-screening of direct marketing. If you believe you have been or are likely to be a victim of fraud, you can ask them to place a ban period on your credit file.

7. Overseas disclosure

We store and manage your information in Australia where we can. Some of our service providers, including the software and cloud systems supplied through Loan Market, may store or access information overseas. Loan Market's policy names India, the European Union, the United States and the Asia Pacific region, including New Zealand and the Philippines.

We take reasonable steps to make sure overseas recipients protect your information in line with Australian privacy law.

8. Marketing

We may send you information about our services, rate reviews, market updates and offers that may interest you. We will only do this where the law allows, and every marketing email includes an unsubscribe link.

You can opt out at any time by using that link or contacting us (see section 13). We will action your request promptly and at no charge.

9. Our website

When you use our website, we may collect technical information such as your IP address, browser type, device, the pages you visit and how you arrived at our site. We use cookies and similar tools to understand how our site is used and to improve it. This information does not usually identify you.

You can set your browser to refuse cookies, but some parts of the site may not work properly.

If you submit our enquiry form, we collect the details you enter and use them to respond to your enquiry. Our calculators are run in your browser; the figures you enter are not sent to us unless you submit them through the enquiry form.

Our website may link to other websites, such as lenders or government sites. We are not responsible for their privacy practices.

10. Keeping your information secure

We hold your information electronically in secure systems, including systems provided through Loan Market, and in paper form where needed. We take reasonable steps to protect it from misuse, interference, loss and unauthorised access, change or disclosure, including password and multi-factor protection, access limited to people who need it, and secure document storage.

We keep your information for as long as we need it for the purposes in this policy and to meet our legal record-keeping obligations, which generally means at least seven years after our dealings with you end. After that, we securely destroy or de-identify it.

If a data breach is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

11. Accessing and correcting your information

You can ask for access to the personal information we hold about you by contacting us (see section 13). We will respond within a reasonable time, usually within 30 days. We do not charge for a request, but may charge a reasonable fee for retrieving and supplying the information, and we will tell you before we do.

In some cases the law allows us to refuse access, for example where it would affect someone else's privacy or relates to legal proceedings. If we refuse, we will tell you why in writing.

If you believe any information we hold is inaccurate, out of date, incomplete or misleading, please tell us and we will correct it free of charge. If we disagree, we will explain why and, if you ask, add a note to your record saying you dispute it. For corrections to credit information, we will respond within 30 days and may need to consult the credit reporting body or lender involved.

12. Complaints

If you have a concern about how we have handled your personal information, please contact us first (see section 13). We will acknowledge your complaint promptly and aim to resolve it within 30 days. If we need longer, we will tell you why.
